General

The purpose of these General Terms and Conditions of Sale (hereinafter "GTC") is, on the one hand, to inform any potential buyer of the terms and conditions under which the seller (hereinafter "the Seller") sells and delivers the products ordered and, on the other hand, to define the rights and obligations of the parties in connection with the sale of SAS LA MAISON CAROLE G products to the consumer (hereinafter referred to as "the Buyer").

Scope of application

They apply, without restriction or reservation, to all sales of products offered by the RELIANCE brand, produced and published by SAS LA MAISON CAROLE G on its website www.relianceparis.com (hereinafter referred to as the "site" or "website"). Consequently, by ordering a product offered for sale on the RELIANCE website, the buyer fully and unreservedly accepts these General Terms and Conditions of Sale, which the buyer acknowledges having read prior to placing their order. The Seller reserves the right to modify these General Terms and Conditions of Sale at any time.

Nevertheless, the validation of the order by its confirmation implies the buyer's acceptance of the GCS in force on the day of the order, the conservation and reproduction of which are ensured by the professional seller in accordance with article 1127-2 of the Civil Code (former C. civ., art. 1369-4).

Modification of the GTC

These Terms and Conditions were updated on October 24, 2024.

The professional seller reserves the right to modify its GTC at any time.

In the event of modification of the GTCS, the applicable GTCS are those in force on the date of the order, a copy of which, dated to that date, can be given to the consumer on request.

Terms and conditions

The nullity of a contractual clause does not entail the nullity of the GCS. The temporary or permanent non-application of one or more clauses of the GTCS by the professional seller shall not constitute a waiver of the other clauses of the GTCS, which shall continue to be effective.

Product features

General

The buyer may select one or more of the products offered on the site. The Vendor may modify the products offered for sale on its website at any time, depending in particular on the constraints of its suppliers, without prejudice to orders placed by the purchaser. Each product is described in terms of its essential characteristics, in accordance with Article L. 111-1 of the French Consumer Code.

The photographs illustrating the products do not constitute a contractual document.

Product use

The site offers a range of products for home care.

LA MAISON CAROLE G provides consumers with the information necessary for the proper use of its products. The company cannot be held liable for damage caused by misuse of the products sold on its website or by failure to follow the precautions for use.

Compliance

The products comply with current regulations concerning personal health and safety, fair trading and consumer protection at the time they are placed on the market. The products comply with French legal requirements in force at the time they are placed on the market.

Stock availability

Products are available and delivered while stocks last.

In the event of unavailability of the product ordered, the seller will immediately inform the buyer and may offer a product of equivalent quality and price or, failing that, a voucher for the amount of the order to be used for any future order.

If the buyer does not agree, the seller will refund the sums paid within 5 working days.

Apart from reimbursement of the price of the unavailable product, the seller is not liable to pay any compensation for cancellation, unless he is personally responsible for the non-performance of the contract.

Product resale

The products sold on the website may not be resold without the written consent of SAS LA MAISON CAROLE G. The products sold on the website may not be repackaged and resold without the written consent of SAS LA MAISON CAROLE G.

Prices and payment

General

The applicable prices are those displayed on the Site on the day the order is placed. These prices may be modified at any time by the Publisher. The prices displayed are valid only on the day of the order and have no effect for the future.

The prices indicated on the Site are in euros, all taxes included, excluding delivery charges in accordance with article L. 112-1 of the French Consumer Code.

The selling price of the product is that in force on the day of the order. The selling price of the products does not include shipping costs, which are invoiced in addition to the price. The total amount due by the customer is indicated on the order confirmation page.

Terms of payment

Customers may pay by credit card (Visa, Mastercard, American Express), Paypal or credit voucher. In the case of credit card payments, the Vendor has no access to any data relating to the customer's means of payment. Payment is made directly to the bank. In the case of payment by money order, cheque or bank transfer, delivery times only begin to run from the date on which payment is received by the Vendor.

Secure payment

The site is equipped with an online payment security system that allows consumers to encrypt the transmission of their banking data via the secure payment platform's electronic payment server. An SSL encryption system is in place to protect personal and payment data. At no time will the consumer's banking data pass through the computer system of SAS LA MAISON CAROLE G.

We reinforce payment security with the 3D Secure system for Visa, Mastercard and American Express cards. An additional step takes place at the time of payment, allowing us to verify the identity of the cardholder and validate the transaction.

Billing

The Vendor will send or make available to the Customer an electronic invoice after each payment. The Customer expressly agrees to receive invoices electronically.

Payability

The price is payable in full once the order has been confirmed. Payment is made immediately upon ordering by credit card.

Reservation of ownership

The Products sold remain the property of the Publisher until full payment of their price, in accordance with the present retention of title clause.

Offer

Domain

The online sales offers presented on the site are reserved for consumers residing in France and/or in a member country of the European Union and for deliveries in these same zones.

Duration

The online sales offers presented on the site are valid for as long as the products appear in the electronic catalog and while stocks last, unless otherwise indicated.

Acceptance

Acceptance of the offer by the consumer is validated, in accordance with the double-click process, by confirmation of the order.

Control

General

To place an order, Internet users can select one or more Products and add them to their basket. Product availability is indicated on the Site, in the description of each item. When their order is complete, they can access their basket by clicking on the "Order" button. They will then be taken to a form on which they can either enter their login details if they already have them, or register on the Site by filling in the registration form with their personal details, or continue as a guest. Internet users can then enter their delivery and payment details and click on "Check order".

Before clicking on the "Confirm order" button, customers can check the details of their order and its total price, and return to previous pages to correct any errors or modify their order.

Confirmation of the order implies acceptance of the GCS and constitutes the contract. The professional Vendor reserves the right to make modifications to the product ordered in line with technical developments, in accordance with article R. 212-4 of the French Consumer Code.

Order confirmation by the Seller

Once payment has been received by the Vendor, the latter undertakes to acknowledge receipt to the Customer electronically, within a maximum of 24 hours. Within the same period, the Vendor undertakes to send the Customer an e-mail summarizing the order and confirming that it has been processed, with all the relevant information.

Order validation

The professional seller reserves the right to refuse any order for legitimate reasons, and more particularly if the quantities of products ordered are abnormally high for buyers who are consumers. The seller may also refuse or delay the processing of an order if it suspects fraud of any kind, such as identity theft or theft of means of payment.

Contract

General

The sales contract is formed when the consumer confirms his order.

Archiving and proof

Communications, order forms and invoices are archived on a reliable and durable medium so as to constitute a true and durable copy in accordance with article 1360 of the French Civil Code (formerly C. civ., art. 1348). These communications, order forms and invoices may be produced as proof of the contract.

Delivery

General

Please allow between 24 and 48 working hours for your order to be prepared and dispatched, depending on order validation and subject to stock availability. Orders placed after opening hours and at weekends will be prepared and dispatched on the next working day and will not be considered as a delay.

Delivery in mainland France and Belgium:

The prepared order will be given to Colissimo, for delivery within 2 to 3 days in Metropolitan France or Belgium.

Delivery in French overseas territories :

The Seller delivers in Guadeloupe, Reunion Island, Mayotte, Martinique, Saint-Barthélemy, Saint-Martin.

Orders to French overseas departments and territories or abroad will be dispatched by La Poste or its subsidiaries and delivered by their local partner. Delivery times vary according to region or country of delivery.

For all shipments to the French overseas departments and territories (DOM TOM), our customers residing in the French overseas departments and territories (DOM TOM) will be required to pay octroi de mer fees as well as any customs fees that may apply depending on the value of the order.

Late delivery

In the event of a delivery delay of more than 5 business days, the customer must inform the customer service department of SAS LA MAISON CAROLE G, which will take the necessary and appropriate action.

However, as delivery times are provided for information purposes only, they are subject to external factors and carriers. SAS LA MAISON CAROLE G cannot be held responsible for any delivery delays, and any shipping costs will not be refunded.

Place of delivery

Products are delivered to the address indicated by the customer on the order form. To facilitate delivery of the order by the carrier, the customer undertakes to make every effort to ensure that the parcel is delivered: name visible on the letterbox, transmission of the digi-code, telephone number.

Product conformity

If the product does not conform to the order, the consumer must send a complaint to the seller in order to obtain the replacement of the product or possibly the resolution of the sale.

Transfer of ownership

From the delivery date indicated on the order form, ownership of the product is transferred to the purchaser, except where full payment of the price has not been received at the time the order is placed.

Product returns and right of withdrawal

Information

The consumer has a right of return of fourteen days from receipt of his order to return any item that does not suit him and request reimbursement, with the exception of return costs which remain at his expense. The right of withdrawal can be exercised by contacting our customer service department directly from our website in the "Contact us" section.

The legal right of withdrawal cannot be exercised if the products have been unsealed or used after delivery and cannot be returned for reasons of hygiene or health protection.

In the event of withdrawal, SAS LA MAISON CAROLE G will refund all or part of the payments received, depending on the condition of the products and the payment method used for the order. This will be done either by re-crediting the consumer's credit card or PayPal account, or by bank transfer. SAS LA MAISON CAROLE G may defer the refund until the products have been received and checked.

For a full refund to be effective, the product(s) must be in perfect condition, in their original packaging and unused, and the products must be able to be returned to stock. In addition, any gifts obtained must also be returned if you are returning your entire order, otherwise they will be deducted from your final refund. Any product returned damaged, in particular due to lack of protection in unsuitable packaging, will be considered as a damaged product and will not be reimbursed. Once the product(s) have been accepted, we will proceed with the refund, deducting the cost of return.

Returns may take between 14 and 21 working days to be processed. After this period, please contact our Customer Service.

Personal data processing

SAS LA MAISON CAROLE G processes consumer information in accordance with its Privacy Policy.

Dispute handling

General

SAS LA MAISON CAROLE G cannot be held liable for any damage resulting from improper use of its products.

In the event of a dispute, you should first contact the company's customer service department by email (contact@relianceparis.com) to attempt to resolve the dispute informally.

Pursuant to Ordinance no. 2015-1033 of August 20, 2015, any disputes that may arise in connection with the performance of these general terms and conditions and for which no prior amicable solution has been found between the parties must be submitted.

Since January 1, 2016, mediation has been mandatory for all. Thus, any professional selling to individuals, is required to communicate the contact details of a competent Mediator in the event of a dispute, regardless of whether they sell remotely or in a physical store (Source: FEVAD).

In the latter two cases, the Seller undertakes to respond within 24 to 48 hours (excluding public holidays and weekends). These times may vary depending on the time of year.

Our opening hours are Tuesday to Saturday from 11 a.m. to 7 p.m.

For all requests made on public holidays, we will take note of your messages the following day (working days). We remind you that you have a period of 14 days (working days) from the date of receipt of the order declared by the carrier to make a claim.

Special conditions

These general terms and conditions of sale do not exclude the application of special terms and conditions of sale.

These terms and conditions are governed by French law.
